A Primer on Required Employee Monitoring Policies under Bill 88

Bill 88 a.k.a the “Working for Workers Act, 2022”

This bill became law on April 11, introducing a new amendment to the Employment Standards Act, intended to provide transparency and privacy protection to workers.

As of October 11, 2022, all employers with more than 25 employees are obligated to create and implement a policy that discloses: whether the employer electronically monitors employees; how the employer monitors employees, and under what circumstances; and the purpose of collecting electronic monitoring information.
